1. Who we are

AuPairMatch (“we”, “us”) runs this website, which lets families in South Africa and au pairs looking for work in South Africa find one another and make contact directly. In these terms, “you” means anyone using the site, whether registered or not.

By creating a profile or using the site you agree to these terms. If you do not agree, do not use the site.

2. What AuPairMatch is, and what it is not

We are a listings platform. We publish what members write about themselves and let the two sides contact each other. That is the whole service.

We are specifically not:

• an au pair agency or placement service
• an employment agency or labour broker
• the employer of any au pair listed here
• a party to any agreement you reach with another member

We do not interview members, check references, confirm qualifications, run criminal or credit checks, verify identity documents, or visit anyone’s home. Nothing on this site should be read as us vouching for anybody. Where a profile shows references, those details were supplied by the member and have not been contacted or confirmed by us.

3. You are responsible for your own checks

Bringing a stranger into your home, or going into a stranger’s home to work, calls for care that no website can do on your behalf. Before you agree to anything, you are responsible for satisfying yourself about the other person. That normally means meeting in person, seeing original identity documents, speaking to previous employers yourself, and obtaining a police clearance certificate.

If you are a family, you are also responsible for meeting your obligations as an employer under South African law, including the Basic Conditions of Employment Act, a written contract of employment, and any registration required for unemployment insurance.

4. We are not responsible for what members do

We also do not promise that the information in a listing is accurate, current or complete. Members write their own profiles. We do not check them.

We do not promise that the site will be available without interruption, or that you will find a match.

5. Limits of this section

South African law does not allow anyone to contract out of everything, and we are not trying to. Nothing in these terms excludes or limits our liability for our own gross negligence, for a deliberate wrong, for death or personal injury caused by us, or for anything else that cannot lawfully be excluded — including your rights under the Consumer Protection Act 68 of 2008.

Subject to that, where we are found liable to you for anything arising out of your use of the site, our total liability is limited to the amount you have actually paid us in the twelve months before the claim arose.

6. Your account and your listing

• You must be 18 or older to register as an au pair.
• Everything in your profile must be true, about you, and yours to publish. Do not upload a photograph of someone else, or contact details you have not been given permission to share.
• Keep your password to yourself. Anything done from your account is treated as done by you.
• One person, one profile. Do not create a profile on behalf of somebody else without their knowledge.

7. What you may not do here

• Harass, threaten, deceive or discriminate against another member.
• Use another member’s contact details for anything other than discussing an au pair position — no marketing, no adding people to lists, no passing them on.
• Scrape, copy or republish listings, or try to extract the database.
• Advertise anything that is not a genuine au pair position or a genuine au pair.
• Attempt to reach data or accounts that are not yours.

We may remove a listing or close an account that breaks these rules, or that we reasonably believe puts other members at risk. Where we can, we will say why.

8. Membership and payment

Registering is free for everyone. Au pairs never pay. Families may pay a once-off fee for a Connect membership, which makes members’ contact details visible for a set period. Current prices are on the How it works page.

What you are paying for is access to contact details for that period. You are not paying for a placement, an introduction service, or any outcome. A membership is not refundable because you did not find someone suitable, though your rights under the Consumer Protection Act still apply.

We do not take card details on this site. When paid memberships are processed, that is handled by a third-party payment provider and your card details never reach us.

9. Content you post

What you write and upload remains yours. By posting it you give us permission to display it on the site to the members who are allowed to see it, and to store it while your account exists. We do not sell it and we do not license it to anyone else.

10. Closing your account

You may close your account at any time by asking us through the contact form. We will remove your listing. Some records are kept for a period where the law requires it — this is set out in the Privacy Policy.

11. Changes

We may change these terms. If a change materially affects you, we will say so on the site or by email before it takes effect. Continuing to use the site after that means you accept the new version.

12. Law and disputes

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction. If something goes wrong, please raise it with us first through the contact form — most things are quicker to sort out that way.
